About these Terms

These Terms of Service govern your use of Harambee, a crowdfunding platform operated by [Legal company name] (“Harambee”, “we”, “us”). By creating an account, starting a campaign or donating, you agree to these Terms and to our Privacy section. If you do not agree, please do not use the platform.

Who can use Harambee

You must be at least 18 years old and able to enter a binding agreement. You agree to give accurate information when you sign up, keep your login details safe, and tell us quickly if you think someone else has used your account. You are responsible for activity on your account.

Starting a campaign

You may start a campaign for yourself, for someone else, or for a group, as long as you are honest about who the money is for and what it will be used for. When you start a campaign you confirm that:

  • everything you write, and every photo you upload, is true and that you have the right to use it;
  • you have the permission of anyone named in your story, especially children and people with serious illnesses;
  • you will use the funds only for the purpose you describe; and
  • you will post updates if your plans change or the goal is reached.

Every campaign is reviewed before it goes live. We may ask for identity documents, medical or school invoices, or other proof.

What is not allowed

You may not use Harambee to raise money for anything illegal, misleading or harmful. This includes:

  • fake or exaggerated stories, or campaigns using someone else’s identity or photos without permission;
  • violence, hate or harassment against any person or group;
  • weapons, illegal drugs, gambling or adult content;
  • pyramid schemes, loans or investments that promise a return; and
  • fundraising for terrorism or any organisation designated unlawful under Kenyan law.

Donating

A donation is a voluntary gift to the campaign organiser. It is not a purchase, a loan or an investment, and you will not receive goods, services or ownership in return. Harambee does not guarantee that a campaign will reach its goal or that the organiser will use funds as promised, although we take the steps in these Terms to reduce that risk.

Donations are generally non-refundable. If you believe a campaign is fraudulent, report it to us and we will investigate. Where we find fraud or a serious breach, we may refund donors where we are able to.

Fees and payments

It costs nothing to create a campaign or to donate. Supporters pay no fee to Harambee. When funds are paid out, we deduct a platform fee of [X]% and the charges of our payment partners, such as mobile money and card processors, of about [Y]%. The exact amounts are shown on our Fees page before you start.

Payments are processed by third-party providers. We do not store your full card details, and their terms also apply to your payment.

Withdrawals and payouts

Before we release funds we may verify your identity, your connection to the cause and your payout details. The name on the payout account must match the verified name of the organiser or the provider being paid.

For larger medical, education and similar campaigns, we may pay the funds directly to the hospital, school or other provider, using the invoice you supply. We may delay or hold a payout while we review a report, a legal request or a possible breach of these Terms.

Your content

You keep ownership of the stories, photos and videos you upload. You give Harambee a non-exclusive, free licence to display, share and promote them on our website, apps and social channels for as long as your campaign runs and for a reasonable time after, so that we can run and promote the platform. You are responsible for the content you post.

Our right to act

We may pause, edit, remove or close any campaign, and suspend or close any account, if we reasonably believe it breaks these Terms, the law, or puts people at risk. Where we can, we will tell you why and give you a chance to respond. If a campaign is closed for fraud, we may withhold or return the funds as the law requires.

Disclaimers and liability

Harambee is a platform that connects organisers and supporters. We do not run, endorse or guarantee any campaign. The platform is provided “as is”, and we cannot promise it will always be available or free from errors.

To the fullest extent the law allows, Harambee is not liable for indirect or consequential losses, or for the acts of organisers, donors or third parties. Nothing in these Terms limits liability that cannot be limited under Kenyan law.

Privacy and your data

We handle personal data in line with the Kenya Data Protection Act, 2019. Our Privacy Policy explains what we collect, why, who we share it with, and your rights to access and correct your data.

Changes to these Terms

We may update these Terms from time to time. If we make an important change, we will tell you by email or on the platform before it takes effect. If you keep using Harambee after the change, you accept the updated Terms.

Governing law

These Terms are governed by the laws of the Republic of Kenya. We will try to resolve any complaint with you directly first. If we cannot, the courts of Kenya have jurisdiction.
